Its not like he intentionally mis-represented the parts,the outcome is unfortunate, he is basically willing to split the losses. From my perspective its a case of he didnt know what he was selling,and
you didnt know what you were buying.
He says keep the parts,sell them and recoup the other half.
 
Have you realized by now that there is a real possibility that sellers may hesitate to sell anything to you? This has turned into a no win situation for both parties. Awsig, you 'win the battle', but you just may lose the war...... Food for thought.

I'm not trying to win any battle or any war. if anything, he would win it all. if he did the refund (which he wouldn't be losing anything on) and I sent them back, he could sell them for what they are. which are 70-72 brackets. there worth more.

I don't think he did this intentionally by any means. I don't want anyone to think that. he didn't know what he was selling, and listed them wrong. when I eventually did what the seller is suppose to do and verify the part numbers, they were wrong for my car. I told him this and he denied they were for 70-72 and still claimed them 73/74. I asked for a full refund and now were here.


The problem is YOU were a prick and thought you should get your shipping back. You have got to be shitting me? You been around this stuff much?

If you buy from anyone and get the wrong part shipping is NEVER part of the deal.

He offered you your money back and you pricked up. That's on YOU.

OP misrepresented the item point blank. But it happens and this is not a huge amount of money in the Mopar world.....

Buyer needs to find a balance and make it work. It's all a numbers game but both of you can just end almost back where you started. As for a Paypal dispute, OP will lose. And I am sure both avenging forces are OK to deal with. This one just needs to get resolved. And move on.

I got popped a few months ago because the seller told me what I wanted to hear when he in fact didn't have the right answer. One phone call would have saved me several hundred dollars but I did dial the digits. So this money lost is no big deal and all part of collecting used parts.....

You original offer is a full refund of $90 and you'll ship them back? I'd love to do that but even Paypal agree's that in order to obtain your refund you'll have to ship the parts back and when they are received the funds get sent back. I'm willing to do that, but only if it's done through paypal which I don't believe can be done as it's been sent to their escalation department. If you can get the terms completed through paypal, I'll do it, in order to end this dispute. My reputation is worth more than this.

Riddler, best take it up with paypal. Make it clear freight/shipping is non-refundable.

Shipping ain't cheap, you could have avoided all THIS (whopping $45) if you had done a little research for YOUR car.

Or just make sure it's for 70-72 duster

No the issue here is he has a 1973... Scamp I think... Needs the bumper brackets for a 1973 Scamp/Duster which is what I thought I had (bought a while ago as 73 brackets). The brackets he bought are 1970-72 brackets....

Yup the cost of the parts, not the shipping. I've given that detail to Paypal. I can't change or do anything else in paypal. This resolution has locked up my account and I can only deal with it and it now says Paypal has until Jan 26 to make a decision, until then I can't do anything, including purchasing parts.

I've made 3 offers to you and you seem hell bent on getting 100% resolution. Guess in todays day and age it's seller beware when it comes to paypal, instead of buyer beware.

You need to confirm in the future what you want to buy and confirm the parts. A picture was available of the parts and if you didn't know you should of asked for part numbers.

Guess it's time to wait for Paypal to make a decision.

I'm currently working with a well known manufacturer of car reproduction parts.
The first part they sent did not fit.
I took pictures for them and returned the ill fitting part with a sample of the part that did fit for them to get the second one reproduced part "right".
The second one is still wrong.
I've now "eaten" original shipping of 20 dollars and the return shipping of 8 dollars once.
I looks like I will have to eat return shipping twice on the second part sent that was wrong.
But to get a reproduced part that fits, I consider the gamble part of the game.

$45.00 is full payment for the price you paid for the brackets. You send them back to him, he refunds you full price of $45.00 you paid for the brackets.

I bought my wife a pair of jeans off ebay for Christmas. I paid the price of the jeans plus shipping. She didn't like the way they fit (not sure what I was thinking!). So, I did a refund request. I send back the jeans and when they get them, I get the cost of the the jeans refunded.
I pay for shipping both ways. That's the way its done, period.

Thank you, that is the common practise for returns. Or some places even do 20% restocking fee.

No matter how right a person thinks they are, if one causes enough of a problem no one want's to deal with them any longer.
I would eat that 45 so fast it wouldn't even be funny, just so I could continue to get or sell parts.
(NOT burn everything down for 45) but some people will obviously.
2 that I am sure of so far. :D
