My X, unable to pay her mortgage on her 4800 square foot house decided to enlist me in paying her mortgage. Our divorce decree stated that I paid child support until the girls were 18. One is 21 and a half and the other turns 20 in March. So, she filed with Texas child services where she lives who then filed with Missouri where I live. All my projects came to a screeching halt (pun intended). I had to come up with the money to hire a lawyer. Even though my hearing is next week, the state of Missouri decided to go ahead and garnish my wages, for what I don't owe. That is $1248.26 a month. Until I can get this settled and the forces of true darkness beat back, my Mopars sit waiting....
 
I hope you lived in Texas when you filed for divorce, that would help. Sure seems shitty that after you've fullfilled your obligation she's back again looking for more :banghead:

I don't mean to play the Devil's Advocate, but are either of your girls in college? Some states allow child support to continue past 18 if the children involved are in college. I think it sucks, but they do. Not sure if Texas or Missouri are like that. Good luck to you!
 
Unless the laws here have changed, you should be done paying anything! Think I'd have to remodel that house.....with a match!

Always heard it was better to divorce than murder. After what I've been through, and now you, I've got to wonder if that ain't a little bass ackwards. The sharks will circle as long as you will bleed. Hope you can find some justice in this case.

Let me get this straight you payed your child support fathfully till they were 18 as agreed and they ain't in college [if they are your in the rears and you owe since they was 18] and she dragged your wallet into court and now your having to pay for her house? Somethin sounds fishey either somebody read something wrong or your being untruthful cause if you fufilled your court ordered payments then ya'll are done,i think you need to speak with a lawyer before this becomes worse. No offence intended but it just don't make sence to me i have been down that road and i would be beside myself if this happened,i did however have the ex go and apply for asststance [everything she could get] and told them she wasn't receving any help from me and i got a summons to a hearing they wanted their money back thank god i saved all my recepts [i was paying her directly at the time] i even had her sign recepts when i gave her cash plus a witness signed too i was exhonorated and they went after her and i went to the court and payed them after that till my daughter was 18.
 
What my X found out was, she could have asked for child support until the girls were 21 but she didn't (it was to get me not to fight her leaving Misssouri with them against my wishes...joint custody when she ran off were her girlfriend) and decided to go after me this past July. She filed with Texas social services who in turn filed with Missouri. They came after me like a dead beat dad. I hired an attorney $2600 so far, but they wouldn't listen. They did schedule a hearing BUT they went ahead and garnished my wages BEFORE the hearing. They started taking $1248.00 a month from my paycheck. I take home about $1400 a month now with kids, mortgage, you name it. I finally was given a hearing on 4 December. The X admitted she knew it ended when the girls turned 18 (one is 21 and a half) but feels she is entitled to the money anyway. The attorney who conducted the hearing told me X she contradicted herself several times and grilled her good. I left feeling we had done as well as could be expected. But the law may still rule in her favor. Here it is the 21st and I have still not heard from the state. I get paid once a month, on the 28th, and that is next week. It is a very bleak Christmas for us. I appreciate your concern. Unless someone has been in the situation, me for example, I had no idea what people can go through screwed over by bureacracy and blood sucker X's. Hey Cassius, if you are out there, if I can get this settled then I want the 360 and tranny. My cars are sitting in the garage wondering why I stopped working on them.
 
Sorry to hear this...it sucks. The man always gets screwed over. I had my payments taken out of my pay by the state and when he turned 18 they stopped.
 
What is it with ex's??? They don't want you, but they want your money....
 
I don't know about Texas and Missouri laws, but in Ohio if you have gone thru the emancipation process. Legally there is no way for her to come back and re-file for child support. The court closes the case and it's considered whole and paid in full, based on the agreement for the divorce. If she has come back and re-filed (because she can't live "high on the hog as she was before child support stopped") then something is amiss.. Either the court in Missouri did not or does not have the proof to show emancipation, or Texas did not recieve it. I had to wait 8 weeks after my son (who was the last one to come off my child support) before they would stop taking my child support out of my pay. I had several "heated" discussions the the childrens support agency, before it finally stopped.. Talk about a pay raise!
However when your done, your done.. Your lawyer needs to fill you in on every aspect of how and why she could have possibly re-filed, as I said I think somethings just not quite kosher..... If they have already started taking money out of your wages there has to be something you've overlooked or your lawyer to give her the ability to prove you haven't paid enough..The last "however is".... In the state of Ohio they can garnish your wages, take your income tax checks, and anything else they deem necessary until you have paid the debt, if your in arrears. And they can sieze any of it no matter what age the children are if you have never paid it, at what ever age you are... in other words till the day you die, they will get their money.. Just my $.02 worth.. I wish you the best in getting it sorted out..

Hey man, I'm still here. Sorry to hear this is still going on. I hope you get it all resolved. The engine and tranny are sitting in the same spot they have been this whole time. They won't go anywhere until you tell me you're ready for them. Just keep moving forward, and if there's anything any of us can do please let us know.
