Still waiting for explanation from the state

For all who have helped and been patient with me on this forum, thank you. I am still waiting for a final explanation from the State of Missouri on my case. My X left me back around 94 for her "lover" filing for divorce of course. She moved to Texas with the kids. The divorce agreement said child support ended when the kids turned 18 and she has never disputed that. One daughter is turnign 20 and the other 22 this summer. This past summer she decided to go after more money. Standard story, she has had 3 new houses since the divorce, many foreign vacations, many new cars, lived the lilfe of Riley and I found having no money is a good way to lose weight. She filed with the State of Texas social services as if I were a dead beat dad (don't need a lawyer) who filed with Missour. Missouri said I owed close to $20 grand, were reporting me to credit agencies, threatened to take my tax refund (this was in July) garnish my wages, suspend my DL, professional license, you name it. And then they asked if I wanted a hearing. I submitted all the paper work, copies of divorce etc. Hearing was in December. They are taking $1250 a month from my pay and last week seized my federal tax refun too. They sent their decision that seems to suggest I won but are still taking my money. My lawyer says I won and we've been weeks trying to get them to tell me if I did, will they stop the garnishment, give my money back, and give my tax refund back. Got a leaking water heater and haven't been able to afford my Diabetes meds in going on 3 months (feed kids or take meds). I am hoping a praying that soon this will be over and I can start work on my cars again (68 Barracuda, 68 Charger, 66 Valiant convert). So many people on this forum have offered me better than great deals on parts I can use and I feel bad having to say "maybe." Thanks for putting up with me.
 
How it worked for me in Michigan is once they recieve a copy to stop the garnishment they will stop it in a few weeks. As far as what they already took the answer I got was we already sent the payments to her according to the rules and if you want anything back you need to sue her for it. So quick answer in Michigan you would need to sue her to get any back after they finally stop taking it.
 
Sounds as if she built her life around that money coming in every month. Some states including Iowa you can be ordered to pay till there finished with college. Now that being said your divorce decree says 18 and its never been desputed. Is there someone in the system you can talk to or your lawyer to talk to so you can speed things up? I know in Iowa its a separate agency that handles Child support. Good luck bud.
 
The state appears to have ruled in my favor. They returned the income tax check refund they seized (it went to pay Missouri's "personal" property tax) and for the new water heater. But I got back the garnishment form one of the four checks. If this holds, I'll be back in business and bugging all of you about should I do this or that with my 2 A bodies (how to restore them). I'm crazy enough that I'm going to try to rebuild the front suspension of the Barracuda, swap torsion bars, and I don't have a clue what I'm doing.
 
Glad to see your troubles look like they are getting resolved.....front end is a not all that hard, as long as things are not to badly corroded....
 
That's great news! Keep your head up man. It can only get better from here. You'll be out cruising those cars in no time now.
 
Glad you got it worked out. I went thru similar issues just this week. My kids are both adults now and my ex claims I still owe her 26K. She filed a claim in two states, I got the one dropped within an hour the other day and the second state is investigating her claim.

Needless to say neither state was impressed by her actions, and I hope they bring her up on fraud charges. I paid my dues to the tune of 562.00 a month for 16 years. I'm done with it and the b@%$h wants more. There are truly some low life people out there.
 
Sometimes a homicide charge is cheaper and is over sooner. :)
 
Thanks for all who have responded. The state finally released both my state and federal income tax refunds. Not much but they paid for the luxury tax (personal property tax on cars) of $1182, and the new water heater. The old one is about 20 years old and leaking so bad but she held on for two months that way. The money helped buy some much needed clothes for the kids too.

My X had to appeal and that means going to the cirucuit court. We have a case against her there as of October but her "friends" told the process server she had moved and we could not get her served. Now, buy filing an appeal, she has served herself. Keep fingers crossed and praying. I might be able to get back the $3750.00 the state has taken in garnishments and we are suing for attorney fees too. If I win, it will be a blow against gold diggers and liars and for men who get crushed in the process. Plus some of you have items for sale I want and need and I'll finally be able to get them. Again, thanks for allowing me to post this.

I hope with everything I have that you desimate her in court. Gold diggers, male and female both, should be subject to pubic beatings!
 
I found, thru personal experience, that getting the judgement against her and getting paid are 2 separate battles.
In short, once you win your case, you'll have sue to get a judgment against her. Then, you'll have to sue again to garnish wages or to gain forceable retainers (seize property of equal value).
Honestly, it will cost more than its worth up front, but the in your face value is priceless.
Keep in mind, this will cost you to file, it was free to her as she was born with a ****** and you a ***** therefore she is assumed right and you wrong prior to going to court. There is a ***** penalty in all 50 states.
I went thru this, I was fortunate, I had no other children and was able to hound the "*****" to the bitter end for not letting "it" go. I wound up buying a some of my things back I lost originally, in an auction she had to hold to pay me for her greediness.

Once in awhile us men get lucky. Almost thirty years ago my 'ex' left when our kids were 7 and 2. She'd found a boyfriend at her work who, unknown to me at the time, got her into drugs. I tried for over a year to put the marriage back together for the sake of the kids but finally filed for divorce. She never contested it, never got a lawyer, and never showed up in court. I bought her out of the house for a low amount to offset a low child support payment from her to give her a break as I kept both kids. She never paid the low child support ($100 per month per kid) so I took her back to court. She cried a story to the female judge and got the child support lowered to $75 per kid per month. I tried to tell the judge that the kids ate more than that but to no avail.
Anyway, she still didn't pay the child support so I ended up having her wages garnished and she and her new husband's tax return money seized. Funny thing was, he knew how much they were getting back and had already gone out and spent it. She had Hell to pay from him once he found out neither the Federal or State return checks were coming his way and that she'd also lost part of her paycheck.
