Downsr, I had good luck calling the county clerk at the courthouse that has jurisdiction over the town said dirtbag lives in. Explain the situation to the clerk and there's a chance you'll get some good information. In my case a guy had written me a bad check and was unresponsive. Talked to the clerk who gave me key words to use and the judges name...clerk let me know I wasn't the first and the judge had told the dirtbag one more bad check and he goes to jail...I had the money shortly after I contacted him and mentioned I didn't want to have to contact judge X. Keep the pressure on and good luck!

$160 bucks, or some very sweet satisfaction.....If I were Downsr, I'd not mention a thing to Justin and go straight to the court. You can collect the cash AFTER he gets out.
 
All this **** because the dumb kid was too stupid to pack things properly, and still refuses to accept the fact that the SHIPPER is the one who needs to make a claim with the shipping company.

I sent him a text saying to pay you back. His response was "No thanks". In less than a minute too. I have unlimited texts, this could be fun...

You don't see any of his parts cars in the background of the trophy cars he doesn't list as parts cars but you see his trophy cars in the background of other trophy cars

I had to hear his side of the story, so I called him, his invite after I texted him. I talked to Justin for almost 1/2 hour, seems like your normal average kid. He just turned 18 and goes by what his grandpa says for advice.

He claims downsr just yelled and cussed at him from the start of the problem. (not making accusations, just relaying info I was told ) Also said his home and cell phone ring a lot since this all started. He said he will wait to pay downsr back when he sees $ from ups. I told him about seller responsibility, yada yada and he stands by his decision. I asked if ups pays him tomorrow, he'd pay back downsr? He replied yes to that. His logic is that if you cuss him out the way he aledged, he's done with you. That was his upbringing. He comes from money, said he didn't need the 160, but stood by not giving it back because, he'd "be out 160 bucks". I did my best father imitation (i don't have kids) about doing the right thing, being young and making a name instead of ruining one, even used an example of a successful parts/cars business man who started out the same way. He remained as solid as an old oak tree.

He was polite to me, never intentionally cocky, and said to call back if I ever wanted to chat about cars.Not saying good or bad about him, again just relaying the info he told me. I hope it gets resolved soon, and peacefully.
 
I, personally have never had to file claim with UPS, usps, etc for damaged or lost shiping, but I have to wonder how it all goes down? how long would it take ups to tell the shipper something?????
but anyway, if there are 4 fabo members on here that got shorted, what is his explanation for that????
 
Here is how I see it...

The seller hasn't completed the sale until the item is shipped and received in good condition.

Until that time, it is the responsibility of the seller to either provide the item or a refund.

As an example. If you buy something from bestbuy via their website, and it doesn't arrive or arrives damaged, they send another one or issue a refund. Every retailer does it this way.

Now, had the buyer paid with Paypal, which I recommend everyone do, he would have had potential recourse against Justin. Some of you don't like paypal, and that's fine. But you have to understand that is the best protection you will get when dealing with something like this. If someone told me they didn't take paypal or a reasonable alternative, I wouldn't do the deal.

As a businessman, Justin should have realized that how he handled this has cost him a lot more then $160. All the people who have read this thread no longer will buy from him, he's banned from the site, and people are telling other sites about him too. In the end, my guess is that Justin will lose a lot more then $160.

Hopefully he learns a lesson. The shame of it is, his grandfather likely doesn't know the whole story and how he's conducted himself. I suspect his grandfather would make the kid understand.

Chances are that his claim will get denied because of poor packing. He has been down this road before and the other thread ended up being 11 pages before he refunded at least twp people.

On the flip side he bought a steering wheel from another member and it was lost. He was demanding a refund and for the seller to wait for reimbursement from the shipping company. He was correct. A immediate refund was the right way for it to be handled and then the seller would wait for a refund from the shipping company.
 
He seems to have more than his share of problems with the shipping system

We ship every day & have only had a few problems in 21 years

I can give you my 31 years experience shipping items with UPS. In that vast amount of time we've only had 3 claims on damaged but heavily packaged and insured item's. UPS will send a claims person to write a report on the cause and extent of damage. If in their opinion the item wasn't packaged properly (they have written guidelines) its singloy charlie. Also they don't just pay the insured the insured value. They can dispute the claim based on true replacement value. Asa rule they will not insure any glass that's not packaged and insured to their standards aka AMD windshield boxes. Anytime you ship anything Ups check their restrictions first. Dan

that doesn't make him any less of a pole smoker. in my book , that makes him even more of douche. I don't care what the excuses are , downsr deserved an immediate refund that actually involved real money and not fake money in the form of a bogus check.he needs a serious beat down and a reality check. one day the spoiled brat will burn the wrong man and he wont say a word, but instead just jump a plane, train or automobile and show up at his doorstep with a nice little surprise.
 
First of all i did not cuss him out.Second his grandmother and grandfather know all about it.His grandfather and justin packed the glass. I have spoken to both grandparents at least a couple of times each.Nothing out of line was said to either they more or less said they would look in to it .End of story nothing done.His grandparents run a business and have dealt plenty with the public. No doubt they are giving him info on how to handle this.They think since i live in another state there's nothing i can do or will let it drop because it will cost to much money .He lets on like he is a nice guy until he has to refund money or you owe him money.That's the way rip off sobs work.He never told me he was going to pay me when he got the ins money.Ups told me when this first happened they told him what they where going to do about the situation. He told me he had it ins for 165 through ups.If i said something to hurt his little feelings that's to bad he needs to grow up and act like man.
 
As I have said a few times earlier what justin says on screen for all to see is far different than he actually says, very dishonest kid and with his smart *** attitude doubt that will change any time soon. Maybe grandpa needs to kick him to the curb and let him learn and pay his own way. Gotta grow up sometime.
 
Perhaps the 4 members that lost money should file suit jointly. More power in numbers.
 
Has Justins full name been posted here,, if not, perhaps it should,, then any Google, Bing, or Yahoo search will bring up this thread... jmo
