A Body bucket seat issue

Bought a used pair of A body buckets and had them recovered. Came out great....Problem is the drivers side is not locking and there's no need to push the button to release the seatback. How much of an issue will this be to fix while the seat is all back together? For some reason the upholstery shop did not address this while it was apart.
 
The hook on the latch may be broken off (seen it before) or it may just be held open for some reason or another.
It's possible the upholstery is even keeping it from moving.
Gotta take it apart and find out like Dave's Cuda said, and I'm sure Dave agrees. LOL
 
Got a photo? What year? For some of them, you need to cut some hog rings & peel the cover back to access all the latch bolts.

Here is a couple of pics. From what I can tell the hook is not mounted properly on the seat bottom. Maybe that's the cause of the problem
