With delayed "medical attention".
5K in damages is the minimum a lawyer will consider taking the case.
He probably would have to pay one up front.
Diminishing returns on that.
And juries don't usually award for "fender benders".

Next time get out of the car and lay in the road.

I hope you have plenty if underinsured or uninsured motorist coverage. I bet that car has the base minimum coverage.
You are correct. Base minimum coverage. It will take more than that to fix the car and replace the trailer. I could sue him for the balance, but it would cost a lot for the lawyer and in the end all I would have would be a piece of paper that says he owes me money.

He was definitely in bad shape at the accident. Police report shows they took his daughter to Ennis hospital, but he was transported to Parkland in Dallas, which is the major trauma center in the area. I haven't been able to find out from anybody how bad he is. He was conscious after the accident, but disoriented.
 
out of curiosity, would you mind naming the other guy's insurance company? My nemesis has been Allstate. They've tried screwing me multiple times.
His insurance is (or was because they will probably drop him) Titan/Home State County Mutual Insurance. When I called them, they referred me to a 2nd company that deals with their claims, who referred me to a 3rd company who handles their claims "this year".
 
I agree with adriver above... you pay your insurance company to take care of you, make the claim through them and let their lawyers fight with the other drivers lawyers. That way you get your damages up front. There's nobody more effective than an insurance company for dragging all the funds due from another insurance company. I got rear ended a year ago while going to a show in the 70 Dart in my avatar. I even got my deductible back when the other guy's company paid out. If you have no fault it shouldn't effect your rates at all.
The problem in my case is that the car was in a trailer. The trailer insurance covers the trailer, not the contents, but if I file with his company the trailer contents is considered personal property and is covered. I am letting my insurance cover the trailer claim and go after the other to get their money back, and I filed with his company for the contents and damage to my truck that was pulling the trailer.
 
Tell your agent … time for him to go to bat for you. Hand the case and files over to them and tell them to roll up their sleeves and get after it. I've done this, and they paid me for my loses, and went after the "other people" to get their money back

If I did that, I would get nothing for the car. Trailer insurance does not cover contents of trailer. The other guys insurance covers the contents of the trailer as "personal property". It's a weird loophole but that's what I have to work with.

Nah, I didn't get hurt, not even back or neck pain. Wish I did, I could use some $$ for pain and suffering!

Not in Texas unless you have special agricultural or ranching insurance that covers anything you tow. My wife works in the insurance industry.

I always insured my race cars through a classic car company. Not for the competition side, but for this exact situation.

Good luck with it... nothing like getting hit and it costing you thousands to be made whole again.
 
I know how you feel being hit in the rear. It happened to me at a stoplight in North Carolina and I watched him in the rear view mirror and gave out an "O ****" and told my wife to hang on. He was unlicensed and tried to flee the scene, but my V6 Accord went through the red lights with him to get his plate #. He had a 03 Ram. NC doesn't have front plates so I had to run after him, to get the info. I never thought he would run and that caught me off guard. Insurance Co. Totaled the car but I drove from NC to NY, without a hiccup.
 
I had a beautiful firechicken, got hit by an uninsured driver. Car was totalled, My insurance paid me 3,500 for it...... not to mention my back is still messed up 20 years later....
I hope it works out better for you.
 
What part hit your duster? Looks like his car went under your trailer. Was the Duster that far forward or was that impact related?
