That guy had the balls to run for state senator last election, after he got out of prison, he did not even get enough votes to be on the primary ballot. He is hated in WV.
He was quite the topic of discussion throughout the mining industry for quite some time. I know that our supervisors had a little slogan drilled into their heads "Kill a miner. Go to jail." I spent many hours building guards for my plant which was OSHA inspected and for the rockheads which had MSHA to deal with also. No matter how thorough your guard is it's all about "incidental contact" and that won't stop some knothead that puts a body part somewhere it does not belong on purpose. Some guards even create their own hazards, added pinch points and reducing safe passage ways for example. 99% of safety is in your own head. Quite frankly, many of the "expert" inspectors didn't have a clue about what they were inspecting. I actually had a rockhead use bolt cutters to cut my lockout off and start the mechanism I was repairing without looking to see why it was locked out.
