Why is an open trailer an excuse for a paint job? Did he race home 50 miles over the speed limit?
You are assuming quite a bit without understanding the problem. I have had paint release for in capabilities which was the painters fault. You can have the best paint/body work then it comes apart. If that happened to you and you had already paid what would your response be?
 
It's all about what is in writing... the contract, and how he needs to prove you broke it.
 
It certainly would put a different light on the subject if we could see the complaint and proof one way or the other. I’m not kicking the paint job because I have no”proof/explanation” of the perceived”wrongdoing” on either party. No one is infallible-even I in my infinite wisdom-have made mistakes. Hard to believe? Yes but I have!!!!!
 
lol you guys kill me i mean that in a good way its about the barracuda i did body & paint on the guy thought it was nice, handed me the money he owed me & left. Now its junk & he wants some of his money back. It has to be all done over from the paint, all the rubber seals, panel fitment & headliner He said he would give me a bad name if i dont. O & he trailered it home from PA. to NC on an open trailer.
This is how I respond to these situations.

"Clearly you wouldn't have picked it up in that condition, right?"
 
i offered to do the hole car over at my expense other than the headliner but no he want the money & he wants it know
 
I wouldn’t of offered him that. Kinda like you are agreeing something is wrong. Him turning that down then saying he wants money is him trying to scam you.
 
I learned long ago to mark parts like heads for instance, I have had guys buy a head then later call and so it is cracked I want to return it and get their $$ back.
 
Well there you go. He wants somethin for nuthin.

That's why Matt videos all his projects when customers take delivery. Kinda hard to dispute the job when you're on video droolin all over it.
 
The fab company I was working for back in 2012, sent out a platform we’d built with a custom, very expensive blue silver paint job. Customer picked it up, 24 hours later he’s back, paint is bubbled on the corners and sides, but no where else. In some spots, it’s down to bare metal. Our painter couldn’t figure out what went wrong. Come to find out, on the customers way home, he went over freshly laid asphalt and splatter tar all over the sides. He couldn’t get it off, so he took bath towels, soaked them in brake fluid and laid them on the sides to try and get the tar off...... he got caught trying to scam us to repaint it for his screw up.

1981 I picked up my old '66 Barracuda from the paint shop (Imron). Car looked GREAT. Took it home and put it in the garage. The previous owner stopped by a few days later. In the few days since I picked it up the entire car showed DA swirl marks through the paint. I took it back. The owner of the shop was more upset than I was. He covered the repaint (prep issues) and DuPont covered the paint (swelled). Sometimes things happen as the paint cures, but there would have to be pics and an inspection.

i dont have papers saying so didnt go to school for it i have a few friends that did & they taught me plus 2 of them are teachers them selves ive been doing this kind of work off & on for about 30 years now full time

I'd say you are a professional. Do you take pride in your work?
 
this does not need to be in writing, a verbal contract is a legally binding contract
he gave you the money you said he owed you and left with his prize, at that exact moment it was said and done
he can argue, disagree and even threaten to sue you, but once he speaks to a lawyer, he will blow away like a fart in the wind
again, once he paid you the contract was completed, his only recourse is to take you to court and PROVE you were negligent
if I may ask, how much money are we talking about?

^not a lawyer either, but I've been sued successfully and it was a harsh lesson about written and oral agreements, and how con artists work the courts. And something a guy never wants to allow to be repeated.
No written terms and no witnesses is where our friendly lawyers are necessary. And in this case, the burden is squarely on the buyer, since he paid and accepted. Anyway, my opinion ended up being the dollar amount must be substantial to ever go anywhere near the courts. We couldn't come to terms during arbitration, and now I know I should have seized that opportunity. I chalk it up as a $4k life lesson.

Guessing, but they must be pretty unhappy to even think of suing. Or bluffing scammers.
