i need some legal advice. please

well , early tonight around 9.30 pm or so I was leaving my work. I work at a high school and there was a football game tonight so there was a ton of traffic. I got to the exit and was attempting to turn left out of the high school and into traffic. Since it was so crowded the high school had hired rent-a-cops to direct traffic. I was the first in line to turn out of the school at this point. finally when I was waved out, I was hit by a car that was still moving through traffic. The person who directed me had not had the other traffic stopped apparently. I shouldve seen the car coming but it was a huge cluster f**k of s**t going on. There was several members of the group of hired security in the road and once I was told to go I was not paying attention to the traffic that should've been stopped. My 02 dodge ram 1500 was hit pretty hard on the passenger door and bedside. after we had determined nobody had been seriously hurt, the security called the actual township cops. During this time, one of the security gaurds who saw what happend told me that I had indeed been directed into traffic. Not the guy who actually directed me though. anyway I was cited for failure to yield after the guy who directed me told the cops he told me to stop. which never happened. Once i was told to go I went. there is no room for mistakes in traffic directing. Do i have a valid reason for taking legal action though? I just want my truck fixed, not trying to get rich by any means. let me know what you guys think. Oh and also this was all captured by a security camera. Ill be checking the tapes tomorrow to see exactly what happened. let me know what you guys think i should do or what options i have. Thanks a lot, any thing will be appreciated.

p.s. sorry for the long rant. I dont like to read too. and also, even if it doesnt work out noone was seriously hurt and i wasnt in my duster. I was jerked pretty hard and kind of am feeling it in my neck tonight though ... hit my truck hard enough to scoot it across the street a bit.
 
First off, you need to get checked out in the ER. My wife and I were rear-ended about five years ago, and she suffered whiplash. That whiplash has grown worse over the years, and she has since been diagnosed with fibromyalgia due to this accident. Take care of yourself first. Not for documentation for future legal action, but only to make sure that there is nothing else wrong besides some sore muscles.

That being said, you need to make sure you got (or get) the name of the other security guard who confirmed that you had been directed into traffic. If you can, get him to agree to be a witness, and take the ticket to court. That, along with the security tapes (as long as they corroborate your story) should go a long way toward proving you were in the right and getting your truck fixed. Good luck to you.
 
Yes, definately get yourself checked out. I got a severe case of whiplash back in 88 when a drunk 18 year old tried to top end his escort into the back of my 67 fastback after he had 8 beers at a party.

Find a good chiropractor to check you out and get you back straight again. If worse comes to worse, you can always replace your truck with another one just like it....
 
If it happened at a school entrance then there probably is a tape from the security camera, if it covers out far enough to see the vehicle entrance. If you can get the tape fight the ticket but if it is not shown on the tape, you will probably lose as the court will side with the person directing the traffic. Chances of one security person going against another is probably not going to happen. I have been in this situation and without hard proof you will lose.
 
Get checked out medically. Then do your homework and get the security tape and any certificates of training for the security officer. This should include records of his being trained in traffic direction. Ill bet when you start inquiring into the training records that they start talking about fixing your truck.
 
I work for a local government and a similar situation happened with our guy screwing up. We fixed the damages. I'm not sure about citations for the other parties.
Now I feel you have a strong case. The kid that screwed up hadn't had traffic control training. He as put into a very rough intersection to control. Management dropped the ball. I was there the night before and it was a handful! Find out the name of the Co. doing traffic control. Then find out employees involved names. If the one will testify that you were instructed great! Find out there training so on so forth. You might even want google the Co. name and see if this has happened before or have they had any legal action taken against them in the past. The school should be able to supply you with the name of the Co. . Your insurance should be informed of everything and they may fight it for you like previously mentioned. It's not gonna hurt to do a little Columbo work on your own to have your guns loaded. I definitly would fight it!
I wonder why the police don't do the traffic control for the games? Hope you're ok and good luck. You don't need a points on your record that you don't deserve.
 
Let your insurance co. handle it.That is what we pay them for,Kevin.
+1 This is what insurance companies do best if they are a good company. They don't want to have a claim ending up "against" them. In other words they Very Much want to prove you in the right. Call them and give them every detail including the Names of rent-a-cops etc... Tell them about the video also.
 
generally, if your under someones control at an intersection, and you do as directed, it's their fault. whenever i was working in an intersection where the signals were out or flashing 4 ways, i would never direct traffic what to do, unless i had to keep someone from hitting one of us or the equipment. the company would of had to pay for it if i screwed up...

Insurance will take care of it, they will also jack up the rates on the next billing if they can..see an at fault accident on your driving record.

The guy who waved you in is now claiming otherwise ? Good luck, good luck in getting your hands on the tape also.

The cops are not on your side apparently since they wrote you a ticket. All you can do is yeah try to see about getting a copy of the tape and what it clearly shows-if anything and take the ticket to traffic court.

I would fight it, what do you have to lose-well time off from work.

The cops in that situation are gonna try to do what they need to resolve it as quickly as possible due to high traffic flows.
