Milodon oil level in small block 4 quart pan

Have installed Milodon #30750 4 quart oil pan on 340 small block yet takes 6 quarts of oil to register full. That's 5 quarts in the pan and 1 in the filter. Contacted Milodon tech support. Reason for discrepancy, per Milodon, was the use of baffle in pan. I take it as oil collects unevenly on either side of baffle and cannot equalize for lack of hole between the two sides. Dip stick is measuring the lower of the two levels. It takes the 6 quarts to fill the baffle side with the lesser level of oil. Has anyone else had similar issue with this oil pan? If this is true I can't believe my dip stick. Any comments? Have verified my dip stick and tube length.
 
I seem to be getting erratic measurements with that pan. I measured it one time and I'm a litre short and the next time its full.
 
I wondered if the dipstick was hitting the baffle and bending when I get the low measurement. BTW I'm not a Milodon fan. They forgot to make a cut out in the baffle for the pickup which I had to do.

I had to do the same. The pickup had to be returned as well. Too high off the bottom of pan.
