Seatbelt ticket

-
I was pulled over for the same reason once, when the officer walked up he said I noticed your not wearing your seat belt, then he saw i had my lap belt on he said, oh your OK and let me go. My shoulder strap was up in its clips. I wonder if he would've known my car had shoulder straps too If would've got a ticket?

Those shoulder belts are a pain in the arse, with it on you can not move to check blindspots, change the radio, adjust the mirror...
I got stopped in my 73 Barracuda back in the late 80s (shortly after the new law).
He let me go but after that I removed the belt. I had a different 69 Polara and it was always stowed so it wasn't seen hanging, never got stopped. I never got stopped in my 67 (that only has a lap belt)

I'm guessing yours was hanging, stow it or remove it, problem solved.

Any authority should clearly understand the difference and that the intent was met. If someone cut the shoulder belt loose I would agree with the authority. I suggest moving to Georgia were you will not be hassled for petty ****!

I only ever used mine at the strip!

And does that mean I must wear all of them. Be a little hard to have front and rear both sets on at the same time. Not trying to be a total smart *** but were does it end!

Read literally it seems as such.
Each passenger is required to use all of the belts available for their seating location that the vehicle is equipped with. There isn’t any fine print or tricks. Ask any Judge, I have.

If the car came with the seat belts, you have to use them. If you added them, you have to use them. If you removed the ones the factory installed, you are in violation of the law.

Rear seat passengers are not required to wear them everywhere yet they are there.

Just a lap belt in our '77 Ramcharger. Only have to wear what it came with, but in your case I believe you needed to be wearing the shoulder belt as well.

However...... IF the ticket said Not wearing seat belt, you could beat it. IF it said "improper use of seat belt", pay up.

Seems like everyone else wants to roll over on this.

Take your country back and vote smart and be safe!

My shoulder belt was dangling when I got pulled over. He probably would of gave you one but who knows

I guess being in the middle seat your kinda screwed cause all you get is the lap belt regardless of year make and model!

No rolling over, It’s the law. You are required to follow it. If you don’t like the law, work to get it changed....but you can’t just ignore it. Until it changes, LEOs must enforce it and citizens must obey it.

Still say it is an auxiliary belt and not permanently attached. You deafeated nothing. Go to court.

I'm guessing a lot of you guys never had an accident with a just a lap belt on. I did many years ago and I bounced off of a lot of things before ending up in the back seat and then the hospital for a week. Over the years every time I drove one of the hobby cars I've owned that didn't have a shoulder belt, I felt uncomfortable about it. Why people don't wear them makes no sense to me. They had to pass a law to remove crazy from the books.

I have and was not good! But that is not the issue being discussed.

Based on that we should all take our cars to the scrap yard or add airbags, antilock brakes and everything else cars have today.

I am Being a little synical but we’re does it end?

I use my lap belt all the time with no issues, some of the cars did not even have a shoulder belt. My 69 fish does but stay strapped up. Until recently I was not required to use one at all in my old 74 truck. State laws vary so hard to say.
Same here. I only wear the lap belt in my 68 Barracuda or 69 Dart. Hell most states don't require school buses to have belts, at all! Florida only requires lap belts and only after the year 2000 they were required when new.

The real issue Is the fine officer that issued the ticket should have been sent to Chicago to do some real good! More people die there and not from using a lap belt!

I just found out earlier it’s a 253 dollars
That's enough reason for me to wear one. They changed the law in Minnesota, making it an offense to pull you over and check out anything else they wanted to. I wear them religiously, I even sold a car that had a belt I couldn't pull out all the way when the law went into effect.

I haven't waved at any cops since I got my license, got pulled over the first time I did.

Good luck in court.

In Ohio, a seat belt ticket is a secondary offense, meaning you have to be pulled over for a moving violation. They're supposed to have a reason to pull you over before giving you a ticket.
Of course, that reason could be about anything. But that can also go in your favor to beat it.
You also don't don't need to be buckled in the back seat unless your a child who weighs less than 40lbs. Oddly enough, in Ohio physicians or chiropractors, newspaper and mail carriers are exempt from wearing seat belts.
Fortunately, or unfortunately, most (not all) cops are actually morons when it comes to the law and older cars.
I was pulled over once and was able to convince the 20 something cop that my 74 Duster didn't come with seat bets. What I wasn't able to convince another young cop of, was the actual law regarding historical plates. I have 1974 Ohio plates on said Duster and the idiot kid that pulled me over had no clue about how Ohio historical plates work. That took a judge scolding a cop about learning the law. That was kinda funny.
Good luck!

We have the old plate deal in Georgia as well, we are supposed to keep our real plate and current sticker on it in the car. My 69 black plate has never been challenged yet, and yes I keep the real one under the seat at all times as well the signed affidavit from the local tag office.

As do I. Didn't stop Barney Fife from writing me for using 43 year old license plates. Asked him to run the plate, he told me he didn't need to since he could clearly see they were expired.

I guess Ohio and Georgia require plates front and rear? In Fl. you only need a rear plate. On the front of my 69 Dart I have a Hillsborough county Fl. 1969/1970 plate on the front. Which Is where I was born and still live

We have a document the county tag office signed and stamped that links the isued plate to an authentic old plate. The old plate must be real and not a repo. I keep it with the issued plate just in case.

I have the Mopar 1969 silver plate on my front yet people ask me all the time what year it is!
