As for it being legal or not, well if its not technically legal but the poster doesn't cooperate what are you going to do - sue them ? That cost money and time and what if you lose ? You might end up making it worst like Kate did
 
Let me just clear things up. I am NOT going to sue this guy or anything like that. He's trying to make some money, good for him. I just found it a bit annoying (and a bit funny) that he used a picture I took.

Exactly! The funny thing is that it's actually a compliment to the truck and the Photographer.
 
If you wanted to take him down contact the beer companies that he has on other magnets and see if he has the rights to use a trademarked product. One would assume that since he has not contacted people to use their photos that he hasn't contacted the beer companies either. I didn't look thru all of his magnets but if he has one with the Harley Davidson, they go after people illegaly using their logo like with a vengance. I have heard at the Sturgis motorcycle rally Harley has people walking around checking for unlicensed HD stuff.
