How do automotive class action suits get started?

The girlfriend has a Ford Ecosport. She's been reporting exhaust smell in it for some time, and they found a crack in the manifold. No biggie, except that new manifolds are only sold with new catalytic converters so it's $800 part, and they are backordered.

How backordered, you ask? 1,150 are currently backordered through Ford, and using an aftermarket piece causes check engine lights.

That's clearly a big problem. How do defective product lawsuits get started? This is an EPA mandated part that also risks user safety.

The key steps involve the initial complaint, followed by the court's review for class certification based on four requirements (numerosity, commonality, typicality, and adequacy of representation).

So you need a group similarly affected with an attorney to file.
 

And to answer a forthcoming question, 1150 back ordered units for a range of vehicles produced, likely in the 100s of thousands is probably not going to get there, yet.
