Unnecessary ticket from a jerk Cop

LOL, no need, My opinion is backed up by the law & vehicle codes of almost anywhere......as You said.....coulda ,woulda,shoulda.............given the Guy a break, but He didn't...
and know what? If there's a next time, the Guy will schedule His new windshield to be replaced in His driveway, as will most people after seeing that....hmmm just what the
intent of such Citations happens to be........imagine that.................

All I'm saying is most reasonable officers would have let it go.This cop is what my neighbor who was a cop for 35 years calls a " ticket writer"
 
Did you watch the video ? He had an appointment and was in the parking lot when he go wrote up. The glass shop guy even said so and they showed the appointment schedule. We can all( me included) guess about exactly what happened but I say the cop was a jerk from what I heard in the video.
I saw unsworn hearsay statements that weren't presented in a Court of Law nor verified with corroborating evidence. Nor was the entirety of the testimony from both sides presented.

I won't pass judgment without fully understanding ALL the facts and will maintain the precept that everyone (including the cop) is "innocent until proven guilty". The court of public opinion based on biased video is not a Court of Law.
 
Agreed, but as they say, "it takes all kinds"..............ticket writers & folks who occasionally are made examples of, out in Your neck of the woods(I've been/driven there
a few times) that windshield wouldn't pose an issue 90% of the time. Where I'm at, many roads intersect from higher elevations at an almost "on-ramp" angle, and that
guy's glass would be useless at seeing a bad situation developing, I have no idea what type of situations/conditions exist where this took place,..but it is what it is for Him
at this point......................

Dismiss it? No way. I'd show up in court with a not guilty plea. In this state the officer has to show up to testify. When he does, the Judge will ream his ***.

Well if you don't pay the fine and choose to appear in court you are appealing the ticket!
Doesn't work that way here. You have to pay the fine in advance plus costs, and then get a date to appear. Then you plead your case. When you lose you spend more money to appeal. Then the cop who wrote it shows.
You get to defend yourself, and you can win but it costs.
 
By the letter of the law the guy gets the ticket. Sure some cops are real assholes. We have a new branch here called "off road enforcement". They got me last summer for riding my ATC with no helmet. The law was set up around here to reduce the injuries to people, mostly young people, who drive their atc's to fast or recklessly and get in accidents. He pulled me over while I was doing my usual 15 kph. Yes, I was breaking the law but sometimes people have to use a little common sense and just give a warning or let it pass. So they ended up getting $172 for the provincial coffers but here is what they lost out on.

I know that part of the province as good as anybody and guess who they called at 3 or 4 am when somebody was missing and they needed to find them. I never charged them a cent for my services but they will never get them again. I used to cooperate with them fully and have even fought forest fires for free. Those days are all over now and I have told them so. Some of them know where I'm coming from but others think I am taking it a little to far. I just tell them, don't you think your officer took it a little to far and go on my way. Tell me who lost in the long run.

So, the guy in the original story, I won't pass judgment one way or the other as I don't know the whole story.

Yes the ticket sucks !
However whenever anyone decides to break the law they run the risk of dealing with the consequences .
I've had tickets when I felt it was unnecessary, and I've got off when I clearly deserved a ticket .
Life works that way .
Plus maybe the cop saw his broken windshield weeks before and told him to get it fixed or another one did ?
You and everybody excluding the cop and the driver don't have all the facts.

Why in the world would you pay a fine for something you have not been proven guilty of. That's absurd.

Where is it that you live where your guilty till proven innocent? Here and most any place that I have gotten a ticket in the South East, if you choose to go to court and have your case decided by a judge, you don't pay the fine until rules against you. Now there may be court cost if indeed the Judge rules against you. But you still stand a chance of the officer not showing up and your case gets thrown out.

2. This article is from May 2017.....about an incident that Happened in 2015 (you can see the court date on the ticket in the video).

4: This story made it's rounds on click bait media like Breitbart etc.in September 2015 fanning the pro/anti police rhetoric.

Here and most any place that I have gotten a ticket in the South East, if you choose to go to court and have your case decided by a judge, you don't pay the fine until rules against you. Now there may be court cost if indeed the Judge rules against you. But you still stand a chance of the officer not showing up and your case gets thrown out.

Here you have ten days to
A. plead Guilty and pay the fine.
B. Plead not guilty pay the fine and court cost and ask for a hearing date.

In Pa. We have a points system. Meaning that depending on the moving violation you get a ticket and points applied to your drivers license. Certain violations result in instant suspension of your driving privileges.
If you get a ticket and are found guilty your insurance company is notified and you get the added luxury of increased premiums.

Now here is the catch. Often the judge will offer to reduce the ticket to something less then written.
Ex. Instead of speeding in an active school zone. Which is a big fine and points. It's reduced to failing to observe a traffic device. Same fine just no points. See how it works.
 
One more thought.
Who's to say the guy wasn't running late for appointment and speeding ?
Cop pulls him over says I'll let you go on speeding and site you for windshield?
Cop might have been giving him a break already ?

That all makes sense and is just like most places EXCEPT...Paying a fine and court costs before you defend yourself. That makes no sense what so ever. So do you go ahead and spend 30 days in jail so you can fight the sentence.?
