They are actually illegal to sell in almost all states! We had them when we were kids, never gave a though to getting injured. I guess we had more common sense than kids today. Or could it be the parents?

Your words made it seem like they were illegal to sell. What isn't clear is private party sales.
Sure, it might be illegal for a store to sell them but if someone wants to sell a set that they have, the government has no authority to stop that. These are not firearms or drugs.
