Neighbors.....again...

Well if I live in said^^^^^ community and I wanted the fence replaced, I would put in a new fence and pay for it! Period! But wait if I raise hell with the city about it, Their going to demand that I only have to pay for half while my neighbor pays HALF? Do I have it right? Hell sign me up! I'll get a fence for half price?
Well, it's not quite that easy, but in a nut shell yes. You can't demand a fence if there isn't one, you have to show that the existing fence is irreparable, show a need and it must be on the legal property boundary line. You generally must also show that you made a good faith effort to resolve the issue with the other party.
My neighbors goats and chickens are always in my yard but so are the deer and the coyote's. I don't generally care, but I could make a case for a fence. But I'm likely on the hook for it to the tune of 50% and where I live, that aint cheap! Besides, the goats do a good job of eating the weeds :)

Well,I live in a village., And on a corner lot 120x120. One day I hope my neighbor asks me to split the cost of a fence down our common property line.I like the idea of a fence for halfprice. But We have always had pretty good neighbors therefor 22plus years. So I'm ok with no fence, too.
While I'm not allergic to stupid today, I do remember years ago when I sorta wuz.
Nice to hear that your wife is proactive. And can handle this kindof Krapp.
Maybe your neighbors IQ could stand enlarging by at least one boot size, lol. Or maybe that would just about make a 100% improvement. :)

I guess what I'm not quite understanding is wanting a fence but wanting someone else to pay half? The wife and I decided to fence in 3 acres of our property. One to keep our black lab in and protect her from roving pit bulls. and two to keep out unwanted people, like Jehovah's witness, people asking "Do you wana junk dem ole cars?" etc. And to that end it has worked out really good. We had 5' black vinyl clad chain link fence installed. 350' x 350' x 350' x 350' and a custom made 15' x 7' aluminum gate with a automatic gate opener. Total price, $16,000.00 All paid by me, because I wanted it!

See! Your normal!
I live in a very rural area, cattle are always knocking down fence, and getting into some other farmers field. I was kinda surprised that the trustees already had a remedy in place, they dealt with stupid in the past.
The neighbor of my rental wanted a fence because the renters had children and a dog. His argument was the kids and the dog keep attracting his dachshund into the rental yard. I think the kids would bring the dog in too and keep it there for a while. I felt for the guy, but hey, keep track of your dog.
I have a dog, since the neighbors goats and chickens get into the yard, no fence. I keep track of my dog, my thought process is this: If my dog gets into the road and gets hit, who's fault is it? The dogs? The driver of the car or me? Simple, me. The dog is a dog and does what dogs do, the driver was trying to get someplace. I let the dog get out and didn't watch it. That's on me. Now, I'm also of the opinion that if my dog gets one of the neighbors chicken while it's in my yard, then it's on my neighbor.
BTW, I've learned that answering the door in my boxers and asking what color is "lil miss blondies underwear" generally keeps the "Ja-Hovies" away.

Oh I too live out in the country. There are cows, goats about 15' from my fence in his fenced pastures. In the case of your dog. Why not protect the welfare of your dog and put up a fence in area for your dog? That was the main reason for my fence. I didn't want anything bad to happen to my Lab. I also didn't want her to cause headaches for any of my neighbors. If your yard was fenced and your neighbors chickens got in your yard, He couldn't complain if your dog ate them!

The neighbors where my Brother used to live had a dog that trashed the wood fence between the two back yards and got through and attacked my Brothers dog.
My Brother asked the guy to split the cost of a new block wall and the guy told my Brother if he wanted a fence he could pay for it himself, and was a real dick about the whole thing.
Well, ny Brother built the fence and had his side all nice and finish painted, but the other side facing the other guy's house they left rough with mortar hanging out and unfinished so one day the guy was out there chiseling the rough stuff off and my Brother called the police on the guy.
The police told the guy that if he didn't help pay for any of the fence he was to keep his hands off of it because it wasn't his property.
Well my Brother is somewhat of a trouble maker, so after all that happened he hung a sign over into the neighbors yard on the fence that said "KEEP YOUR HANDS OFF MY FENCE!"
Guy calls the cops and reports it, and the cops tell the guy he can't touch it without being arrested. :D

OMG, common sense isn't dead. :D

I like your brother's thinking. I would have done the same, but I would gone one step farther. When his neighbors dog got in my yard, he would not left it alive! Sounds cruel, I know, but the only way to get to ignorant dog owners is thru there dogs. Years ago before I put up my fence, I had a neighbors Pit Bull come over and would steel my beagles food. Sure enough he comes over and fights with my dogs and killed two of my beagles. Next night I was waiting for him when he came over to get in the dog food. Funny thing is that dog died of lead poison that night for some unknown reasons?

After the people across the street moved in and a guy came around handing out "sexual predator in your neighborhood" flyers I looked out front one day to see their pit right outside our front door, so I walked out the door with a stainless Colt 357 in my hand and asked them if that was their dog.
Never happened again.
I wouldn't have hurt the dog as I could tell the second I stepped out the door he was just a good ol boy, but it got the point across to the owner in a hurry that this isn't community property for their dogs.
I kinda nipped them in the buds right off the bat you could say.

Was just talking to Butch, the neighbor behind us. He was outside replacing some glass in his place. The neighbor that has taken down the buffer fence broke some of his windows. In an attempt to keep the Eagles and Ospries away from his yard the "farmer" fire his 12 gauge into the air. What goes up must come down...and thru Butches windows. The "farmer" apparently fires the 12 gauge at an angle. Butch told me that this is not the first time he has had pellets hit his place. He confronted the "farmer" about this....and got a shoulder shrug from him. No apology, no offer to pay for the damages. Butch has told me that if he can contact the Sheriff and State Patrol about the farmer firing into the air like they do.
