Things I am dealing with !

I paid for my property and never had a mortgage on it Mitch, I have the release from back in 2006 when the seller sold part of it to me, I have all the track and land location and had it servaide (how ever it is spelled) but this bank sold the land owner's loan he made in 2008 to to another bank #-o The bank that bought his loan did not look closely into his deeds and land ownership and just seen he had what he owned back in 2004.. if they looked farther in to his loan and ownership papers they would see they cant put a judgment on my property becouse I own it, it give me a head ace trying to explain #-o In short I do indeed own my property and they over looked the loan papers at the new bank, they screwed up! and me trying to talk to someone way up north in N.J. has been an imposable feet ! This all went bad when a bank sold an old loan to another bank :banghead:

Here is where your problem probably is.........
When you made the transaction with the original owner did you have a title company invovled?

Just because you hired a surveyer and sectioned off the tract of land titled in your name does not mean there was not an claim by a crediter existing.

That is why a Title company would be a neccessity in real estate transactions.
Very well could be a legitamit claim that was not uncovered due to the small amount of money saved by not involving a Title company.

I realize in your part of the world things are done differently than the rest of us.
My in-laws in Mammoth Spring are building a house with out prints (Contrctor building off a graph paper drawing produced by my mother in law ...LOL), no permits, inspections, impact fees etc.
 
Thinking may have you beat....monster wild fire, burning out of control, to the NW of us. Care to guess which way the winds are blowing? Only be a matter of time before the smoke grounds the air craft.. again. County declared state of emergency....state said, last I seen, we are sh*t out of luck in regards to help from them. Bad enough that DNR has asked for civilian volunteers to help. Bad enough that the Canadians are helping on the other fire, further north.....

68 has a point though. If you didn't have the parcel checked through a title company before you bought it, they may have a legit claim.

If it was checked by a title company, contact them, they are responsible.
 
I agree a title search is a necessary expense when purchasing property.
 
Sorry to hear this Mike, I was also following this on FB! I agree that it's time to get a lawyer involved, sounds like a mess that only a good real estate lawyer can straighten out! Praying for a quick resolution in your favor on this!! Geof
 
Did you do a title search Mike.Did you register your deed with the county as soon as you bought it.Hope so and wishing you luck bud.
 
if title co. did your search, contact them. if not, contact a good Jew lawyer.

if needed, my cousins in Ga that were the bad guys on "Deliverance" can be hired.

but seriously, you can go to your county's recorders office and research all the details of the property. from my days back with Farm Credit Services, (decades back, ) if there was a lein on the original owners property, ( that you bought from), he must have had his lein holder issue a " release" of your parcel, and this should have been recorded in co. office. then of course, if he sold it to you, a warranty deed in your name. that put the pproperty lrgally in your name, and if $$ borrowed from that point on, all would have been recorded and when paid off, release recorded also?????

Yes and yes Pete, all in my name for 10 years, I have all the county records and faxed them to these people and called (hours on the phone getting the run around :glasses7:)
I have everything, Deed, the release to me (lot 3 and 4 ) from the bank that had a loan on 4 lot's, brother kept two and built home and there home loan is just on 2 lot's and the bank that bought his loan did not see that the original on the2 of 4 lots was indeed released to me and it is in the courts records, I had it servaid and registered 9 years ago :glasses7: Cinlar looked at the very first loan when they bought the loan from his (my dumb *** brother and sister in law's) bank :banghead: ..

I waited all week for Thurday, I was PO so I asked my waife to text my brother to see if anything happened today (this was at 7pm) .. He text back saying yes ! I talkd to this person and that person and some other BS... Treva text him back and ask WHEN WAS You going to tell Mike about this #-o, He friggen knew I have been waiting all damned week for Thursday and .. and !! I have text him this morning at 5 am (he says he is up every morning by 4) To meet me for breakfast at Fat City 6 am, why the F#$%^ didn't he call yesterday to tell me,, I say BS.. He did not do anything this week !! :banghead:

Sorry to read about this Mike! I hope this whole issue gets resolved soon, and you can get back to living a nice peaceful, relaxing life on the hill!
 
Had a similar instance occur a few years ago. We have owned a certain piece of land for over 60 years now. The adjacent property was sold and the new owner got a survey that was showing they owned land 8 feet over onto my property. We had a fence in place for over 60 years I have a shed also close to that boundary. One day the air head wife of the neighbor who was not much brighter was out front with a skid loader pulling up my corner post and telling my wife we may have to take down our shed! The sheriff was summoned and stopped them cold. We knew for a long time the surveys in this area are off and that they should always measure from the railroad not the properties to the west. Did they listen NO! It all got sorted out but I did lose some sleep like you talked about. VERY AGGRAVATING!
 
Mike sounds like your documents are spot on. If they don't respond like gentlemen and admit the mistake, a lawyer may be needed. The stress and aggravation may warrant a counter suit. I think the casual incompetency of banks is still a sour subject since the whole bubble break. A lawyer may help expedite it and take some of the worry away. Throwing the brother a beating may relieve some stress ... at least for a little while....Good luck...hope this gets cleared up quickly for you.

Fanny May called Friday and again this morning and her people are on this to repair there mistake on this, She called me personaly :color: and called my brother Friday, Well today at 11:05 am her lawyer called and said he wanted my wife and I to know they are repairing this and he got all my faxes Treva and I sent, He said he see's the problem and is working on it to send me and my bank a clearance/release and thanked me for the patients it has took to resolve this right away :cheers:
Nun of this was my brothers fault and they have been stressed over it aswell and felt very bad I had to go threw this, Like I said, It was nothing I did wrong and I was fit to be tied :banghead: This good news this morning as settled me down so much I passed out on the couch and don't know where 3 hours went :???: It's looking good so far folk's , Thank you all for your input and concern :color: it douse help to talk about things like this at times, Karl (KrazyKarl) I want to do that some times :D

My wife and I had Cenlar servicing an equity loan that we had for a long time. We finally paid it off and went through the paperwork to close it out. Then they sent us a bill saying we owed some more money to them. We had the paperwork trail and phone logs to prove that was false. Needless to say it took far longer than it should have for us to close out our dealings with Cenlar. I eventually went and read reviews about them online and it was horrible to say the least. Thank goodness we got out from under them.

I did the same and was so worries they was going to try and put the corporate screws to me and make me loose a year getting things dun around my little home on the hill, glad you got out from there load stuff, I will never ever deal with these folks, I keep my loans here in town so I can see someone face to face :glasses7: Thank you.

Unhealthy for all of us. I don't do well under stress. Not well at all. I bet the responsible parties haven't offered any compensation for causing you and your families all this trouble.
 
you know, this problem with banks in general go all the way back to Jessie James days. he could rob banks and railroads and the general public took his side!!!!
they even captured his brother Frank once and tried him in Gallatin Mo, and jury found him innocent ( after many bank and train robberies !!!!!!) ha
glad you got all the mess resolved!!!!
