Hi Folks

A bit of a rant............

I just got home from a 5 hour round trip in a snow storm to look at a nice, low mileage Toyota Rav4. The car was great...We negotiated a price and shook on the deal. All that was left was for him to take the car in for a safety inspection on Monday when the shops opened.

As I pulled into my driveway, I got a text from said seller advising that someone had offered him more than our negotiated price.....So he **** canned our deal.

WTF....I know it's his car to do with what he wants, but isn't a man's word worth anything anymore?

LOL......I texted him to request an E-Transfer of $100 bucks to compensate me for the wasted fuel, so we'll see if I hear back :)

Mixed feelings on this subject... Back around 92-93 I shook on a deal as the seller... Gave the buyer "a few days" to get their financing sorted... Then had a person wanting to buy the car with cash in hand... Offered $250 more than the handshake deal.... But was wanting a deal today cause it was for the daughter who had to leave for college the next day.... I honored the handshake... And the "buyer" flaked...

From that day forward money in the hand is better than a handshake....
 
I'd never sell to someone else or take interested buyers out of line. If I sell something on Facebook marketplace I keep in order. Can be more of a pain but no need to piss somebody off.

A quick call to the buyer requesting a deposit is all it would have took to confirm if they were serious or not. If the buyer started flaking then....Bye-bye. JMHO

I can get a pretty good feel for a buyer. If the dude drives 5 hours, and I haven't mis-represented the article...chances are he's pretty serious. There were things the seller had to get in order before the transfer could take place...I assured him that finances were not an issue (I know, famous last words lol). Had he contacted me and advised of another offer, I would have sent him a small deposit verifying my commitment.....I would have expected him to honour our negotiated price.

BTW....I would suspect when the other dude offered him 2 grand more than our negotiated price...He would have returned my deposit forth with. LOL.

I agree with you, but back in 92 cell phones didn't exist so I left a message but didn't get a call back till the buyer had moved on...
And yeah, if they had driven 5 hrs I would be confident they were serious...
 
Complete two copies of your state official bill of sale on the spot.

An agreement with a handshake is a legally binding contract in court I always heard.

it can be. however, there needs to be one party that has acted on and shown reliance toward the "verbal" contract. ie made a payment or started work.

basically, it lies in the burden of proof.
 
it sucks that the dude didn't honor his deal, but i've been smoked the same way before and learned my lesson.

deposit and paperwork otherwise it's not a done deal.

as a seller, who's had somebody have a change of heart after hammering out a deal i don't feel as though i'm under any obligation until some amount of money changes hands.
 
Parties know that there won't be any legal action unless a significant amount of money was lost either way. No way in hell would I be going down that road just because a seller flaked out on a used car deal if I was whole.
 
About 15 years ago both the seller and I signed a bill of sale. I gave him a $500.00 deposit. This was on a Saturday. He said the would bring the car out on Monday and get the rest of the money. I get a call Monday at noon saying that his wife was in an accident and totaled off the car. He said his wife was ok and that was a relief. He said he would send the deposit back to me. I got the deposit. A month later I see the car in a mall parking lot. I wait for the ppl to come out and ask them who they got the car from? Guess who. I went to see the seller and told him what a lying POS he was. At least it made me feel better. Kim
 
I just made an agreement with a fellow on marketplace on a 1970 383 block I have. Good for rebuild. His buddy needs a block for his Challenger. He is driving 12 hours to get it! All good by me. Price is quite cheap and he can't find anything closer. Tonight I dig it out of the corner and start snooping around. Wouldn't you know it. I kept it for a reason. No VIN stamped on it. Warranty block! The old boy with the Challenger just got an even better deal.

If you want something done right......

do it yourself.

I'd not rely on anyone to deliver anything to me (other than long distance mail transactions with verified sellers like ebay or FABO), if I could at all transport it myself.

I visited with them for 2 hours and found out he grew up 10 miles from me. He was a little older but I knew his brothers pretty good so we reminisced a little. He was surprised I knew so many ppl that he knew. I felt I could trust him. Kim
 
I found and bought a car dolly so I could take my purchases with me immediately.

It's been one of the best $450 investments I've ever made (plus a $150 winch), as now I basically own a "tow truck" and it has saved my *** more than a few times.

Helps to have three vehicles that can all tow each other, if necessary.

Great plan.....Unfortunately, with a newer vehicle, a title search needs to be done immediately prior to handing over the cash.
