Any ideas sold car??

Heres the story,any suggestions Guys and Gals??
I have 3 Mopars 1970 Road Runner 62,000 mile unrestored car,1968 H code 383 4 speed Dart,and a 1968 Dodge Coronet 440 two door.
The 68 Coronet was my first car.I bought and restored it when I was 15.Parked it in 1991 due to loss of insurance to many tickets.I tore it apart in 2002 or so to redo it again.Well I worked on it for a year and ran out of money and it has sat since.I decided to sell it this summer.I know,I know its my first car.But I have always wanted a true Mopar Muscle car now I have two.I wasn't going to sell the Road Runner or the Dart.I realized the Coronet was just going to sit there for a long long time.My Dart is a 36,000 mile very clean but some what cut up car.So I would rather focus my time and money on the Dart.I always wanted a real Big Block Dart.
Well anyway I put the Coronet up for sale last Aug.18th.I had a guy Chuck called at the end of Aug.Chuck came and looked at the car and gave me half down $3400.00.Chuck said he would be back Sept. 10th with a trailer and the rest of the money.Chuck called on Sept 8th and said I have a trailer and a SUV.I said OK but where are you going to put all the parts?Chuck said I will find a truck and call you back.Never heard back from Chuck.So I called him a few weeks later.Chuck said I do not have time to pick up the car right now but I will send you another $1000.00 and pick the car up in a few weeks.I said fine.Chuck calls and leaves some kind of message with my wife.So I wait a week and call Chuck back.Chuck gives me a story I said no big deal stuff happens this was the 1st of Nov.He said I will send you another $1000.00 by Thanksgiving I will call first! Well guess what NO call or money from Chuck.
You think he would have called to work something out.Or said you know what I am not going to have the rest of the money until spring I will pay you for the car then and pay you storage if that is OK. Something I do not know!!
Well I know more than a few guys would have stuck it to Chuck by now. I am not like that but I am getting a little PO .I still have the Car and the title.If I had the $4400.00 Chuck sent me I would send it back and tell him to forget it.I last heard from Chuck around the first of Nov.My wifes keeps telling me to call him but I thought I would just wait and see how long before I heard from him.
Any ideas or suggestions.

I,d contact him and give him a date to finish the trans action by or the car goes up for sale. When sold i would give him a refund minus a few hundred for down for deposit,whatever you decide on with him on this call.
 
Just recently he has run into logistic problems. I say that because the money hasn't seemed to be the problem. No you can't wait forever but I'm sure if you were in his shoes you would thankful ( thanksgiving ) if you tried to work with him.
You should contact him and set a date of 60 days or so for him to complete the transaction. You should stress to him you are disappointed in the lack of contact and he needs to respond quickly to avoid further complications. If you never set forth a date he had to comply by, he hasn't violated any law that I know of. If you set a date he agrees to and he violates that date, you are under no obligation to him to return any money. I hope it doesn't come to that but I also hopethat if it comes to that, you would still refund part of his money.
Yes you should be able to retain some of it for your faithful attention in the deal but I think you should be fair and only keep what you think your out. Bad part is that your car may be worth a little less than when it started.
The real deal is, how will you feel when this is all settled? Sometimes cases like this end up in front of Judge Judy. (TV Judge Show)
But the fact your hear seeking input is a good thing. It means your are a caring person, but still don't want to be taken advantage of. Good luck.

Send whatever timeline you decide on in notarized letter in a registered envelope. CYA.

call him up and tell him to come get his down payment. what hes doin is keeping the car with a down patment on it so no one else can get a shot at it. give the punk his money back and sell it for another 500 bucks.
 
I guess I really don't care if I don't see the money for a while.I just do not understand the lack of communication.You think he would call and ask to work something out since he already gave me $4400.00.I will not screw the guy I am NOT like that ,just a little PO.I could of used the rest of the money and garage space to work on the Dart.

If it were my money, I'd be concerned that the seller would start charging me storage or worse, sell the car. Was there a bill of sale and the total amount spelled out?? Whatever you decide, I would definitely put it in writing, have it notarized and mail it registered mail. Be friendly but firm. I think that's all it will take. A deadline and some firm, friendly communication so everybody understands what's expected.

Well I still have never heard back from Chuck.I called him this Wed. no answer so I left a message for him to call me back.Now its Sat 10:10 PM and I still have not heard from him.Damn people seams like I always get the nut jobs to deal with. LOL Jim
 
I think that you have been more than patient. I'd send him a registered & cetified letter telling him that you hope hes ok but since he hasnt returned your calls if you dont atleast hear back from him by the end of the year you are going to have to relist the car and you will send him his deposit back when/if it sells MINUS the difference between your agreed price and what you sell it for now as well as a holding/storage fee. Be sure and CC: an attorney you know or have used in the past even if you dont send a copy to them. Might take it a little more serious that way and light a fire under his ***. Chucks getting free storage and your agrivated right.Give one last message,If I don,t hear from you by ??I,m selling.No response..I say sell..Take wife out stay happy.
 
I think you have waited long enough, send him a certified letter stating that he has 30 days to pay the balance and pickup the car or he loses all his deposit.I bet he moves faster and makes the dead line.If not his loss.It wouldn't bother me in the least to do it.
 
This would be a good idea but I don't have his address Dart-Swinger.Anyone interested in a 68 Coronet 2 door It may be going back up for sale...

I called Chuck Today Monday 5:00 PM again and left a message again.
ANYONE WANT TO BUY A CORONET MAY BE UP FPR SALE AGAIN.

'68 is the best year for the Coronet ( In my opinion ), I would love it But I'm up to my tail in my '68 Barracuda. If it wasn't for my '68 we'd be talking. Any pics?
 
I found Chucks address today.I think I will be sending out that Certified letter as DartSwinger said.I will give him until Jan 12,2009.That will be 41/2 months since he gave me the Deposit.I also let another message today.

Youre much nicer than i! In that letter I would say that i'd hold the car till X date and then the money he gave would be mine, and the car will be sold to "that one guy who has been waiting in line for it"...

.....and now it's Chucks turn to belly up. Impound yards in my area get $30 per day. How long have you stored it? If you have it inside and need the space you need to put it outside and put a tarp on it. Did you agree to store it inside for him? I agree with Daredevil. Do the letter thing and if he don't come around sell it and keep some of the funds for your trouble and storage fees. Show us pics of the car.
 
I think you've gone way above and beyond with this potential buyer .. I remember many, many years ago I fell in love with a Triumph motorcycle and gave the guy $200 to hold it for me, when $200 was a LOT of money to me.. After 2 weeks I couldn't come up with the balance and he wouldn't give me a dime back !!! I learned my lesson the hard way.. A deposit holds a vehicle until final arrangements are made for payment, usually within a couple weeks..

You could have potentially sold this car when times were a little better, and given this person's complete lack of communication with you, I don't think anyone would think any less of you if you just "wrote him off", keep the deposit and sell the car.. It would be different if he had a problem that he conveyed to you, and asked you to hold the car, but since he doesn't care to communicate ??? Bye bye deposit.. You've been MORE than fair already...

Damn Chuck gave me $4400.00 and only owes me $2400.00.Maybe he died or something I dont know.You think he would call and work something out.He was the first guy to look at it.The bad part is I had atleast 15 calls on it after he gave me a deposit in August.I could have sold it to someone else I am sure.
When I put it back up for sale I will also offer to take an A Body in trade also keep that in mind guys.
