Train Hits Stupid Driver

-
I didnt watch the whole thing because i can't stand these kind of videos, but did anyone address the fact the truck pushed the white car onto the tracks ?
Yes, it does appear that the truck pushed the smaller vehicle, and that the smaller vehicle is still operational, which still begs the question of why she did not just drive forward and get the **** out of the way of the oncoming train!?

Maybe it stalled?

Maybe she turned the key to start it and it didn’t start, likely because it was still in gear.

Panic ensues and she gets out.

or when it was hit, did it have a fuel pump shut-off trip?

No, because she got hit, drove through the gate, jammed on the brakes, shifted into reverse, backed up, hit the gate, stopped, thought a while, backed up a bit further against the gate, and THEN got out and walked away (at any point of which she could have just driven straight ahead, where NOTHING was blocking her, and been safe).

Never watched video, but read the analysis. Two things for sure, truck driver is at fault no matter the circumstances you rear end someone you’re at fault. If person in car died that’s man slaughter.

Maybe up there, but not around here.

If the driver wasn't doing something else illegal, like being drunk or running from police, and wasn't in the process of assaulting the victim, it's an accident.
He may be charged with reckless driving, or speeding, or failure to maintain a safe distance or to yield, but if he's coming through an intersection too fast, swerves to miss someone in the crosswalk, jumps the curb, and runs over a kid on the sidewalk, that's speeding, reckless driving, and (usually) driving without a license, but that's it.

I have a 34 year old niece that would likely do the same thing.
