Even that can still leave grounds to contest the will. I have a lawyer in my family. Any reason can be used, how much can be done about it depends on what the person wants to spend on attorney fee's. A good friend of mine was sued by his sister because she didn't like how their parents wrote their will. To save time and money, best way is to have everything POD and TOD. The paperwork at the bank doesn't cost you anything and it only cost me $75 for the paperwork for the house because the state of Missouri wouldn't accept anything done on the computer.As long as you mention them and leave them $1.00
It's hard to contest, using the he didn't mention me in the will, so he wasn't of sound mind.
Payable and Transferable on Death. Have issues unto themselves. They are not the be all to end all. It's like trying to open a safety deposit box to claim owner ship of a deceased. In our family, there was no need for a POA, that's what the TOD and POD are for, once you put the person (s) name on the documents it's a done deal. I've never heard of anyone contesting those. Has to probate it and any bills have to be payed first. Even POD And TOD can be contested. Been there done that. So let's say you have a POD or TOD but the person who had Power of attorney closed all the financial accounts and transfers them as well as sold all the other assets like property to themselves for $1.00 then resold it for actual value. The people holding the pod or TOD. Good luck.
