A friend had that problem and got screwed cause the lawyer really wanted the easy settlement moolah and was probably on the ins payroll.


Your friend had to accept the settlement because until he signs off the lawyer can only try to negoiate a settlement until a trial takes place. I can't buy the lawyer being on the insurance payroll because it would be a conflict of interest and a violation of the law. Most of the time the client is in a big hurry to get their hands on the money and end up settling for chump change. There are some lawyers that are worthless and that is why you research before contracting with one.
 
I think you need to let the your insurance company and their lawyers litigate the case. Keep the explanation as simple as possible.
 
After reading all the opinions that a driver rear ending someone is always at fault I had to chime in, it is NOT, always the case, and I am not taking sides here. I rear ended a car once at a traffic light and I was not charged, even though I thought I would because I was driving a tractor trailer at the time. In this case it was a two lane road that turned into a left turn only, and a straight, right turn lane. Well I was in the right lane and someone was in a hurry to get by the big slow truck and raced by me on my left and cut in front of me to go straight. But by the time he did this we were almost in the intersection and the light changed to red and he slammed on his brakes to stop. Well since he cut in front of me so close to the light there was no way I could back off enough to avoid hitting him, and I pushed him into the intersection. After the cops arrived and gave him my side of things, and after listening to the other guy who I guess told a similar story, the cop handed me the paperwork, and said you are not at fault and let me go. It sounded like the other guy got a ticket but I don't really remember that part as it was 20 years ago! So there can be extenuating circumstances.
 

Here is the results of a rear end collision that my son and I were in. I was sitting still in the grass strip on an interstate when a drunk guy plowed into me at about 70mph. Hit so hard it knocked the factory radio out of my dash.I had a headache for over six months and a back ache for more than a year.

I hope they get well soon and glad it wasn’t any more serious. I hope also that you find a good lawyer and the insurance doesn’t give more trouble. As a senior, I know how important family is. I have AARP home and car insurance and they have been very reliable in times of need. Again, hope all works out for the best.
