That's right. Most of you think I was a lowly inlisted man, but I've decided to come clean. I REALLY retired as a full Admiral with..............

Well OK, not.........but the courts have now decided that "Stolen Valor" is just fine, in fact, it's one of our "rights"

SAN FRANCISCO — A federal appeals court on Monday tossed out a veteran's conviction for wearing military medals he didn't earn, saying it was a form of free speech protected by the Constitution.

A specially convened 11-judge panel of the 9th U.S. Circuit Court of Appeals ruled that the First Amendment allows people to wear unearned military honors.

Elven Joe Swisher of Idaho was convicted in 2007 of violating the Stolen Valor Act, which made it a misdemeanor to falsely claim military accomplishments. President George W. Bush signed it into law in 2006, but the U.S. Supreme Court struck it down in 2012 as a violation of free speech protections.

Investigators looked into Swisher's military claims after he testified at the 2005 trial of a man charged with soliciting the murder of a federal judge. Swisher wore a Purple Heart on the witness stand.

Swisher testified that David Roland Hinkson offered him $10,000 to kill the federal judge presiding over Hinkson's tax-evasion case. Swisher said Hinkson was impressed after Swisher boasted that he killed "many men" during the Korean War.

Prosecutors say Swisher enlisted in the Marine Corps a year after the Korean War ended but was never wounded in the line of duty. Swisher was honorably discharged in 1957, and discharge documents indicate that he didn't receive any medals, according to the 9th Circuit ruling.

During his 2007 trial, prosecutors showed the jury a photograph of Swisher wearing several military medals and awards, including the Silver Star, Navy and Marine Corps Ribbon, Purple Heart, and the Navy and Marine Corps Commendation Medal with a Bronze "V."

Swisher's attorney Joseph Horras of Boise, Idaho, couldn't immediately be reached for comment Monday.

After the Stolen Valor Act was struck down, Congress passed a new law making it a crime to profit financially by lying about military service. President Barack Obama signed it in 2013.

After Swisher's conviction, Congress removed a provision making it illegal to wear unearned medals.
 
so he was wearing a purple heart without earning it you say ?

tell me, what would he have to do to earn that medal ?
 
The Purple Heart is awarded to members of the armed forces of the U.S. who are wounded by an instrument of war in the hands of the enemy and posthumously to the next of kin in the name of those who are killed in action or die of wounds received in action. It is specifica lly a combat decoration.

LOL. I'm finally old enough and feeble enough that probably would not happen. But I admit, it is infuriating to think some of these cowards actually hide behind these lies.
 
This is going to open up a whole 'nother can of worms. Does this mean that the family of Admiral Jeremy Boorda, former Chief of Naval Operations, can now sue for wrongful prosecution? If I remember right, Admiral Boorda took his own life because he was being investigated for allegedly wearing medals he wasn't entitled to.
 
Not good, guys that been there done that don`t take this stuff lightly.

honestly though, given the respect our armed forces have been shown for, say, the last 7 years, this shouldn't come as a surprise to us :banghead:
 
9th circuit court...that's what I expected when I read the first line...they're a bunch of lib-nutjobs that make a mockery of the US courts
 

When I was 2 years old, I was in the "infantry"....

I was stationed just south of there at Moffett Field, and a few times while out for lunch we were yelled at and spit on, every now and then someone would buy our lunch. I retired after nearly 25 years, been in all the crap since 87 and the dishonor displayed by these idiots wearing un earned medals really pisses me off, we took care of one guy once in all places a VFW!

CAANG, Avionics shop chief.

That must have been interesting. I ended up at Miramar, ETR-2, I "fixed" GCA. They had about the same thing as the recent govt shutdown in 72, and I got extended there, so spent 4 years there.
 
USN 8 years ended as a IS1, then went guard for 16 ended up as a MSGT. Moffett was pretty interesting, USAF rescue. A lot of deployments!
